It's Roberts by a comfortable margin. Taney bent over backward to shore up an unjust and horrific system, but Roberts is actively working to create a new one.

There have been some really bad supreme courts. The Waite and Fuller courts were every bit as bad as the current court. There were a string of decisions in the last third of the 19th century that made this country much worse than it would have been otherwise.

Nah, Rehnquist birthed the modern court. Roberts could never surpass him. All Roberts did was carry out his former boss’s final directive.

I would say worse than Taney, if for no other reason than he had Taney to look to as a cautionary example. It's why I find our current fascists worse than Nazis: we all grew up learning about their example. Everyone knows that path is unadulterated evil.

I think Roberts beats him by sheer volume of horrible decisions. And I am not exactly familiar with Taney’s feelings on stare decisis but Roberts has completely obliterated it. Pretty sure Roberts and his majority would be on board for Dred though.

How could Roberts, after reading both dissents, stay committed to the faulty logic of the majority? I can understand Thomas and Alito of course, but Sotomayor’s and Jackson’s arguments are so crystal clear. How were they not persuasive to the middle? I’m baffled.

I'd put him ahead of Rehnquist, Fuller, or Waite at this point. If Fuller had written Plessy or Waite had written US v Harris, then maybe it'd be a tie for second.

As far as the worst justices go, I'd pick either Alito or Thomas, but yeah Roberts is insanely bad as a Justice, and really hurt America in Loper Bright and Trump v United States, which hurts the administrative state and gave presidents basically dictatorial powers.

Just wrote a note to myself about this! How long to overturn Dred/Plessy! Failure to address those wrongs is fully manifested in country today. The legal long game-unspooling civil rights is impressive. Legal system upended by loyalists all along. Timing an intentional mockery of country’s founding.
