5/5 If Biden decides to withdraw, he should just say something like, "Being president is a full-time job. Campaigning for the presidency is a full-time job. I'm too old to work two jobs, so I'm going to focus on the one I was elected to do. Vote Harris in November!"

4/ Add in the fact that Harris would be the first woman president and only second president of color and it gets scarier. Add in that her replacement would be from the other party and it starts to look like an invitation to assassination attempts.

3/ We are in a moment of high and rising political violence. ~ 9% of all US presidents have been assassinated, and ~ 13% have been either killed or wounded in an assassination attempt.

2/ ... confirming a new VP requires majority votes in the House and the Senate. If there is no VP, then Mike Johnson is next in line to the presidency. I think there's a very good argument that the House would not confirm anyone Harris nominated as VP.

1/ I'm agnostic as to whether Biden should withdraw from the race. It's a genuinely tough question IMO. But I have clarity on one thing: He should absolutely not step down as president. If Harris becomes President, the Vice Presidency is empty. Under the 25th Amendment ...

/3 I think about Grandma taking a taxi to the hospital to have my mom, forbidding my grandpa’s parents from calling him to let him know — he was on base studying for the supply officer test the next day, and doing well would determine where he was assigned, and maybe whether he’d live or die.

Things are pretty fucked up and the future is uncertain — probably the worst in my lifetime (perhaps excepting 1969 before I can remember). When it’s like that, I like to think about my grandparents and what they faced and got through with the Great Depression and WWII. /1

This is what I mean earlier when I said the GOP elite are unimaginably stupid. The young guys have marinated their entire lives in echo chambers. They are not gonna succeed in abolishing the 20th century. If they try, *actual conservatives* will be against them. IVF is the most obvious example.

Gonna have to reform the curricula a bit. Conlaw is now part of American History. Soviet studies is run by the law school. Journalism is now a minor in sport studies. Computer science is run by the business school, contains no programming, and business majors are dualed with "creative fiction"

The only two permutations of this that work are: 1) Biden stays in 2) Biden steps aside for Harris but remains in office Everything other permutation of this idea is either a fantasy or propaganda whose discussion is designed to get the Dems to lose the election and usher Trump into power.

Now, that being said, don't go saying "so we have Nixon or Clinton to blame for this because if they'd tried and lost then we'd have direct precedent" because seriously what has given anyone the impression that this Court cares about previous SCOTUS decisions.

I think it's important to clarify that it is not at all safe to say that Nixon's or Clinton's stories would've turned out differently if they'd made the full court press on presidential immunity. There is every reason to believe that the SCOTUSes of their times would've laughed them out of court.

/3 5 or 6 SCOTUS judges, who normally love harmless error like a 15-year-old-boy loves a tube sock, will find that it doesn’t apply to introduction of evidence of Presidentially-immune acts, and that the NY court didn’t analyze official acts doctrine right and remand for more proceedings.
