It's almost as if there was a time when people recognized that what they were about to say was indeed shameful and they would be shunned if they said it, so they were at least bright enough to keep their mouth shut.

Maybe fifteen years ago some wag (possibly at the blog Balloon Juice) pointed out that this was basically Sarah Palin's conception of The First Amendment. It's an interpretation that's really been catching on, Sarah Palin is clearly underrated as a Constitutional Scholar.

No. No. No. No. No. If [fill in name] is being an asshole, you are totally entitled to say he's an asshole. Indeed, you can say it if you're wrong. The Times keeps suggesting that only assholes are entitled to free speech rights. It's interesting to speculate on why they think that's so important.

Coming from the NYT's editorial board... it makes sense. Their idea of journalism is letting your coverage and opinions be skewed by petty feuds. And, they fully slant their coverage to one side. Since that's their idea of "honest journalism", what else should we expect?

Societal shunning is a peaceful means of protecting society from those who selfishly seek to destroy it. Similar to Ostracism (from the Greek word ostrakismos) was used by ancient Athenians when citizens who posed a threat to their society were banished from Athens for 10 years.

US citizens have a right to say whatever they want, provided it's not inciting/threatening bodily harm, is not slanderous, or otherwise considered to be unprotected speech. Keep in mind this protects US citizens from THE GOVERNMENT. You are still subject to the social rules of US culture.
